I don't believe that it needs to be prior to signing the agreement for the ARU to be charged. By their own media they held to the idea of five franchises for no more than five weeks after signing. If it can be proven that they were thinking of the force from the beginning then they are guilty of at least failing to act in good faith. If it can be Proven that they supported the rebels in the background, then there are some anti-competitive practices that need to be followed up
