Police said Flatley, 30, recorded a blood alcohol reading of .108 in a roadside breath test near his home at Mermaid Beach on the Gold Coast at 3.28am (AEST) on November 3.
"We've learnt our lesson and will move on from it," Flatley told reporters following a brief appearance in Southport Magistrates Court.
"I'm just applying for a work licence - that's all I've got to say."
Flatley did not enter a plea and is due to reappear in court on January 10.
It's been a tumultuous year for Flatley, who played 38 Tests for Australia and 114 matches for the Queensland Reds before his shock retirement in March last year.
The former Reds skipper separated from his wife Kahli earlier this year after six years of marriage. They have two primary school-aged children.
Flatley, who made his name as a five-eighth, hung up his boots based on medical advice as he suffered from continued blurred vision due to a series of head-knocks playing rugby.
He has since worked in promotions and as a motivational speaker. Last year he was a contestant on reality television show, Celebrity Survivor.

I'd have thought after all the concussions Flats has had he'd handle himself well with blurred vision and delayed reactions.
