    QANTAS WALLABIES CAPTAIN JAMES HORWILL CLEARED TO PLAY

    Qantas Wallabies captain, James Horwill has been cleared to play in Saturday night’s third and deciding Test against the British & Irish Lions.

    Independent Appeal Officer Graeme Mew, from Canada, this morning declined to uphold an IRB Appeal brought against Horwill after he was cleared of a foul play charge at a previous judicial hearing.

    The Qantas Wallabies captain was initially cleared by Judicial Officer Nigel Hampton QC who found that on the balance of probabilities he could not find an intentional or deliberate action of stamping or trampling.

    Horwill was alleged to have stamped or trampled on British & Irish Lions’ lock, Alun Wyn Jones, in the third minute of the opening Test of the DHL Australia 2013 Lions Tour in Brisbane on Saturday 22 June.

    Mr Mew noted that “for the appeal to succeed the IRB would have to establish that there was some misapprehension of law or principle by the Judicial Officer or that his decision was so clearly wrong or manifestly unreasonable that no Judicial Officer could have reached the conclusion that he did.”

    Following a two and a half hour appeal hearing conducted by video conference, and extensive deliberation, Mr Mew concluded that the Judicial Officer had not made any errors of law or principle.

    “There was sufficient evidence upon which a reasonable Judicial Officer could have reached the decision that was made,” Mr Mew said.

    “Accordingly, it could not be said that the Judicial Offer was manifestly wrong or that the interests of justice otherwise required his decision be overturned.”

    Mr Mew also stated that the IRB's appeal had been properly taken in the discharge of its responsibilities to promote and ensure player welfare and to protect the image and the reputation of the game.

    Regardless of the fact that he did stamp on Jones's head and has priors against numerous players such as Pek etc al, I am glad that this IRB review has been nullified. It would have set a very dangerous precedent and all decisions woudl then be subject to numerous appeals and never ending litigation. Sick of Lawyers making a mint off things like this.

    Move on - Nothing to see here...

    Well the IRB were damned which ever way the decision went; by not clearing Horwill, it would have made their own process look inept and contradictory; and by clearing Horwill they now look like they have no faith in their own process. Either way, the mistake was to make an appeal in the first place, all it does is reinforce the image that they have an agenda. (And agenda which can be backed up by past examples, which have been mentioned on this forum before)

    Australia needs to be more proactive by citing Owen Farrell's mountaineering and Mako Vunipola's shoulder charge to the face of Ashley-Cooper; taking the moral high ground and trying to "be the better man" and saying "ah it's nothing, that's rugby" and not citing players is foolish if you're not met with the same level of goodwill. I happen to think that the Vunipola incident was pretty innocuous, but I'm sure if you slow the footage down and show it multiple times in replays; you can make him look like the most evil man in rugby. All you need is one commentator to say "Just look at his eyes, you can see his intent!!! He was sizing up Ashley-Cooper! etc... etc..."
    And then the tabloid press take over from there...

    Australia is being naïve in not taking action (even though people will see it as childish and un-Australian to make a tit-for-tat response) against an orchestrated and persistent Home Unions media campaign to rid them of one it's players. (Or three of its players, if you also count the media beat-up concerning the Hungry Jack's incident) The fact that it's being done under the guise of the IRB only makes our world governing body look like it's playing favourites and has no faith in its own due process. Not a good look for an organisation making its debut at the Olympics in three years time.

    I don't disagree on Vunipola, but suspect they were never going to complain - given his performance, they'd be thrilled if he plays next week.
