How are they for blindside flankers though, that is (IMHO) his best position

Bath have Josh Bayliss, who has been capped by Scotland, but is arguably a better 8, and a collection of players who can play at a reasonable level along the back row. Their top back rower is Sam Underhill, but he's an openside.
Fergus should be able to work his way into the side, but having missed out on pre-season with his new teammates it may take some time before he's familiar with the calls/moves.

How does a club that can't afford to pay it's players retain the ability to loan out players?

That's a good question. Worcester tried to hive off the company that owned the player's contracts from the main club which was going under administration, which would allow them to still own the players contracts even if they weren't paying them. A judge put a stop to that.

But I assume that if you can loan players out, the administrators would see that as a liability off the club's books (assuming Bath are paying Fergus directly).

He’s not been missed by Bath, from the Bath news release:

Australian Lee-Warner headed for Sixways in the summer after competing for Western Force in Super Rugby AU. At 6ft 4, the 28-year-old is second row adept at playing in the back row and topped the statistical charts for tackles and offloads after Round 2.
